Conditions

1. General requirements for participation

As a rule, the course participant must have reached the age of 18. Special conditions apply to minors, which must be agreed in individual cases between the legal guardians and HLS Education Center GmbH.

2. Terms of payment and prices

2.1 Each course at HLS Education Center GmbH comprises a certain number of teaching units of 45 minutes each. The amount of the course fee depends on the package booked. The course fees are due upon registration. A copy of the ID or passport must be presented for registration. Upon registration, the participant must pay the full course fee within 14 days, but no later than one day before the course begins.

2.2 The course participant bears all bank fees incurred with the payment of the course fee.

2.3 Course fees for lessons not taken will not be reimbursed.

2.4 For registrations from abroad (excluding EU countries), a processing fee of € 100.00 is required to prepare the necessary documents.

2.5 If a course participant wants to receive a registration or participation confirmation in the form of a document, the course fee must be paid in full.

3. Contract

3.1 The contract for participation in the language course comes into being upon confirmation by HLS Sprachschule GmbH.

3.2 The confirmation of the contract will be sent by HLS Education Center GmbH after receipt of the participant’s registration form and the course fee in the HLS Education Center GmbH account.

3.3 Every external participant must take a compulsory placement test on a date set by HLS Education Center GmbH. If a course participant withdraws from the contract after the announcement of the test, the cancellation conditions set out in §4 apply.

3.4 If the course participant changes the data recorded in the contract and thereby causes administrative effort, the first change is free of charge. For every further change a cost contribution of € 50.00 is due. This change fee is only charged once for all courses booked.

3.5 HLS Education Center GmbH reserves the right to cancel courses if the number of participants is too low or to combine courses of the same level.

3.6 The contract with HLS Education Center GmbH implies lessons, rooms and administration. Any examination fees are added separately and are not included in the price, unless this is included in a special service package. All textbooks and teaching materials are also not included in the price, unless this is included in a special service package.

4. Withdrawal

4.1 The withdrawal must be made in writing. It takes effect at the time of receipt at HLS Education Center GmbH. The cancellation applies to all courses booked at HLS Education Center GmbH, unless expressly requested otherwise in the cancellation notice. In this case, the administration fee is only charged once.

4.2 If a course participant withdraws no later than eight weeks before the start of language training, HLS Education Center GmbH will retain an administration fee of € 150.00.

4.3 If a course participant withdraws from the contract later than four weeks before the start of the first booked course, he is only entitled to repayment of the course fee if the course place can be allocated otherwise. In this case, HLS Education Center GmbH will keep an expense allowance of € 299.00.

4.4 If a course participant withdraws from the contract after the start of the course without having registered, he is not entitled to repayment of the course fee, unless there are demonstrable serious personal reasons, e.g. serious illness, death in the family or failure to issue an entry visa. These are to be claimed within four weeks after the start of the first booked course. In this case, HLS Education Center GmbH will refund the course fee – minus the administration fee of € 150.00. If a student would like to take the course from the above postpone serious reasons, HLS Education Center GmbH must be aware of this at the latest two weeks after the start of the first course booked by him.

4.5 However, if a course participant has received a registration or confirmation of participation from us as a document and then unsubscribes from the course, the participant is not entitled to a refund of the course fee paid.

4.6 The postponement of the course start is possible on condition that the HLS Education Center GmbH is informed about it at least two weeks before the originally planned course start.

5. Cancel

5.1 If the current course is canceled without demonstrable serious personal reasons, there is no right to reimbursement of the course fees. The cancellation conditions specified in §4 apply to courses booked below.

5.2 If there are serious personal reasons for dropping out after the start of the course, HLS Education Center GmbH will reimburse the course fee – minus the administration fee of € 150.00. The written application for pro rata repayment of the course fee must be submitted by the end of the course, stating the reasons. Unless otherwise expressly requested, the cancellation applies to all courses booked.

5.3. If a participant in a group course cannot attend the class one or more times, he / she is not entitled to a refund of the proportionate course price.

6. Arrival

6.1 The day of official enrollment is the start of the course. HLS Education Center GmbH must be notified immediately of any delay.

7. Course organization

7.1 The provisional assignment to a course is based on the information on the registration form. It is the responsibility of the participant to prove the language skills required to enter a course immediately. HLS Education Center GmbH reserves the right to review this prior knowledge.

7.2 The final classification takes place after the previous knowledge has been checked by HLS Education Center GmbH. The HLS certificate of the previous level is recognized as a direct admission requirement.

7.3 If the result of the placement test deviates from the preliminary placement, the course participant will be allocated a place in another course that corresponds to his or her level of performance.

7.4 The HLS Education Center GmbH is responsible for the local and time-based allocation and division of all booked courses.

8. Obligations of the course participant

8.1 The course participant himself has to ensure that his stay in Germany is legal. HLS Education Center GmbH requires a valid entry and residence permit for the duration of the course.

8.2 The course participant is responsible for taking out health, accident, liability and household insurance. HLS Education Center GmbH assumes no liability in this area.

8.3 The course participant is obliged to comply with the course and house rules applicable at HLS Education Center GmbH. This applies in particular to the obligation to be present. If HLS Education Center GmbH determines a sustained and unexcused absence and the person concerned does not change his behavior despite a formal warning, he can be excluded from further course participation. In this case, fees will not be reimbursed.

9. Liability

9.1 HLS Education Center GmbH is not liable for the loss of its services due to force majeure or for other reasons for which it is not responsible.

9.2 The course participant is liable for all damage caused culpably and has to pay the respective costs.

9.3 HLS Education Center GmbH is not liable for theft or loss of valuables.

10. Data protection

The course participant agrees that his data (e.g. name, home address, address in Germany, nationality, date and place of birth) will be recorded electronically by HLS Sprachschule GmbH. HLS Education Center GmbH undertakes not to use this data contrary to the contract.

11. Right of withdrawal

You can revoke your contract declaration within 14 days without giving reasons in text form (e.g. letter, fax, email). The period begins after receipt of this instruction in text form, but not before the contract is concluded and also not before our fulfillment of our information obligations in accordance with Article 246 § 2 in conjunction with § 1 paragraph 1 and 2 EGBGB and our obligations in accordance with § 312g paragraph 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. To meet the cancellation deadline, it is sufficient to send the cancellation in good time.

12. Applicable law, place of jurisdiction

German law applies to the contract. The place of jurisdiction is Bochum.

Allgemeine Geschäftsbedingungen

1. Allgemeine Teilnahmevoraussetzungen

Der Kursteilnehmer muss in der Regel das 18. Lebensjahr vollendet haben. Für Minderjährige gelten besondere Bedingungen, die im Einzelfall zwischen den Erziehungsberechtigten und HLS Education Center GmbH zu vereinbaren sind.

2. Zahlungsbedingungen und Preise

2.1 Jeder Kurs bei HLS Education Center GmbH umfasst eine gewisse Anzahl von Unterrichtseinheiten á 45 Minuten. Die Höhe des Kursbeitrages ist vom jeweiligen gebuchten Paket abhängig. Die Kursbeträge werden mit der Anmeldung fällig. Zur Anmeldung ist eine Kopie des Ausweises bzw. Passes vorzulegen. Mit der Anmeldung muss der/die Teilnehmer/in die Zahlung der vollen Kursgebühr innerhalb von 14 Tagen leisten, spätestens jedoch bis einen Tag vor Kursbeginn.

2.2 Sämtliche mit der Zahlung des Kursbeitrages anfallende Bankgebühren trägt der Kursteilnehmer.

2.3 Kursbeträge für nicht in Anspruch genommenen Unterricht werden nicht erstattet.

2.4 Für Anmeldungen aus dem Ausland (EU- Staaten ausgenommen) werden für die Erstellung der nötigen Dokumente eine Bearbeitungsgebühr von 100,00 € verlangt.

2.5 Wenn ein Kursteilnehmer eine Anmelde- bzw. eine Teilnahmebestätigung in Form eines Dokuments ausgestellt bekommen möchte, muss der Kursbeitrag voll bezahlt sein.

3. Vertrag

3.1 Der Vertrag über die Teilnahme am Sprachkurs kommt mit der Bestätigung durch die HLS Sprachschule GmbH zustande.

3.2 Die Bestätigung des Vertrages wird von HLS Education Center GmbH nach Eingang des Anmeldeformulars des Teilnehmers und des Kursbeitrages auf dem Konto von HLS Education Center GmbH übersandt.

3.3 Jeder externer Teilnehmer muss einen obligatorischen Einstufungstest an einem von der HLS Education Center GmbH angesetzten Termin ablegen. Tritt ein Kursteilnehmer nach der Bekanntgabe des Testes von dem Vertrag zurück, so gelten die unter §4 festgelegten Rücktrittsbedingungen.

3.4 Wird vom Kursteilnehmer eine Veränderung der im Vertrag erfassten Daten veranlasst und dadurch Verwaltungsaufwand verursacht, so ist die erste Änderung kostenfrei. Für jede weitere Änderung wird ein Kostenbeitrag von 50,00 € fällig. Diese Änderungsgebühr wird für alle gebuchten Kurse nur einmalig erhoben.

3.5 HLS Education Center GmbH behält sich vor, bei zu geringer Teilnahmezahl Kurse ausfallen zu lassen oder Kurse der gleichen Stufe zusammenzulegen.

3.6 Der Vertrag mit HLS Education Center GmbH implizert Unterricht, Räumlichkeiten und Verwaltung. Etwaige Prüfungsgebühren werden separat zugerechnet und sind nicht im Preis enthalten, außer dies ist in einem speziellen Leistungspaket inklusive. Alle Lehrbücher und Lehrmaterialien ebenfalls nicht im Preis enthalten, außer dies ist in einem speziellen Leistungspaket inklusive.

4. Rücktritt

4.1 Der Rücktritt bedarf der Schriftform. Er wird zum Zeitpunkt des Eingangs bei HLS Education Center GmbH wirksam. Der Rücktritt gilt, wenn in der Rücktrittserklärung nicht ausdrücklich anders beantragt, für alle bei HLS Education Center GmbH gebuchten Kurse. Die Verwaltungsgebühr wird in diesem Fall nur einmalig erhoben.

4.2 Tritt ein Kursteilnehmer bis spätestens acht Wochen vor Beginn der Sprachausbildung zurück, behält die HLS Education Center GmbH eine Verwaltungsgebühr von 150,00 € ein.

4.3 Tritt ein Kursteilnehmer später als vier Wochen vor dem Kursbeginn des ersten gebuchten Kurses von dem Vertrag zurück, hat er nur dann einen Anspruch auf Rückzahlung des Kursbeitrages, wenn der Kursplatz anderweitig vergeben werden kann. In diesem Fall wird von der HLS Education Center GmbH eine Aufwandsentschädigung von 299,00 € einbehalten.

4.4 Tritt ein Kursteilnehmer nach Kursbeginn von dem Vertrag zurück, ohne dass er sich eingeschrieben hat, hat er keinen Anspruch auf Rückzahlung des Kursbeitrages, es sei denn, es liegen nachweisbar schwerwiegende persönliche Gründe, wie z.B. schwere Krankheit, Todesfall in der Familie oder Nichterteilung des Einreisevisums vor. Diese sind innerhalb von vier Wochen nach Beginn des ersten gebuchten Kurses geltend zu machen. In diesem Fall zahlt HLS Education Center GmbH den Kursbeitrag – abzüglich der Verwaltungspauschale 150,00 € – zurück. Möchte ein Kursteilnehmer den Kurs aus den o. g. schwerwiegenden Gründen verschieben, so muss HLS Education Center GmbH spätestens zwei Wochen nach Beginn des ersten von ihm gebuchten Kurses davon Kenntnis haben.

4.5 Wenn aber ein Kursteilnehmer eine Anmelde bzw. eine Teilnahmebestätigung als Dokument von uns erhalten hat und sich anschließend vom Kurs abmeldet oder kündigt, so hat der Teilnehmer keinen Anspruch auf eine Rückerstattung des geleisteten Kursbeitrages.

4.6 Die Verschiebung des Kursantritts ist unter der Bedingung möglich, dass die HLS Education Center GmbH mindestens zwei Wochen vor dem ursprünglich geplanten Kursbeginn darüber informiert wird.

5. Abbruch

5.1 Wird der laufende Kurs ohne nachweisbar schwerwiegende persönliche Gründe abgebrochen, besteht kein Anspruch auf Erstattung der Kursgebühren. Für nachfolgend gebuchte Kurse gelten die unter §4 festgelegten Rücktrittsbedingungen.

5.2 Können schwerwiegende persönliche Gründe für einen Abbruch nach Kursbeginn geltend gemacht werden, zahlt HLS Education Center GmbH den Kursbeitrag – abzüglich der Verwaltungspauschale von 150,00 € – anteilig zurück. Der schriftliche Antrag auf anteilige Rückzahlung des Kursbeitrages muss unter Angabe der Gründe bis zum Ende des Kurses vorliegen. Der Abbruch gilt, soweit nicht ausdrücklich anders beantragt, für alle gebuchten Kurse.

5.3. Kann ein Teilnehmer/ eine Teilnehmerin eines Gruppenkurses ein oder mehrere Male nicht am Unterricht teilnehmen, so hat er/sie keinen Anspruch auf Rückerstattung des anteiligen Kurspreises.

6. Anreise

6.1 Als Kursbeginn gilt der Tag der offiziellen Einschreibung. Jede Verspätung ist HLS Education Center GmbH sofort anzuzeigen.

7. Kurseinteilung

7.1 Die vorläufige Zuweisung zu einem Kurs erfolgt nach den Angaben auf dem Anmeldeformular. Der Nachweis der für den unmittelbaren Eintritt in einen Kurs notwendigen Sprachkenntnisse obliegt dem Teilnehmer. HLS Education Center GmbH behält sich eine Überprüfung dieser Vorkenntnisse vor.

7.2 Die endgültige Einstufung erfolgt nach Überprüfung der Vorkenntnisse durch HLS Education Center GmbH. Als direkte Zugangsvoraussetzung werden das HLS-Zertifikat der vorausgehenden Niveaustufe anerkannt.

7.3 Ergibt sich aufgrund des Einstufungstests ein von der vorläufigen Einstufung abweichendes Ergebnis, so wird dem Kursteilnehmer ein Platz in einem anderen, seinem Leistungsniveau entsprechenden Kurs zugewiesen.

7.4 Die örtliche und tageszeitliche Zuweisung sowie Einteilung aller gebuchten Kurse obliegt der HLS Education Center GmbH.

8. Pflichten des Kursteilnehmers

8.1 Der Kursteilnehmer hat selbst dafür Sorge zu tragen, dass sein Aufenthalt in Deutschland rechtmäßig ist. HLS Education Center GmbH setzt eine gültige Einreise- und Aufenthaltsgenehmigung für die Kursdauer voraus.

8.2 Der Kursteilnehmer ist für den Abschluss einer Kranken-, Unfall-, Haftpflicht- und Hausratsversicherung selbst verantwortlich. HLS Education Center GmbH übernimmt keine Haftung in diesem Bereich.

8.3 Der Kursteilnehmer ist verpflichtet, die bei HLS Education Center GmbH geltende Kurs- und Hausordnung einzuhalten. Dies gilt insbesondere für die Anwesenheitspflicht. Stellt HLS Education Center GmbH nachhaltiges und unentschuldigtes Fehlen fest und ändert der Betreffende sein Verhalten trotz förmlicher Mahnung nicht, kann er von der weiteren Kursteilnahme ausgeschlossen werden. Eine Erstattung von Gebühren erfolgt in diesem Fall nicht.

9. Haftung

9.1 HLS Education Center GmbH haftet nicht für den Ausfall seiner Leistungen durch höhere Gewalt oder aus sonstigen von ihm nicht zu vertretenden Gründen.

9.2 Der Kursteilnehmer haftet für alle von ihm schuldhaft verursachten Schäden und hat die jeweiligen Kosten zu begleichen.

9.3 Bei Diebstahl oder Verlust von Wertgegenständen haftet die HLS Education Center GmbH nicht.

10. Datenschutz

Der Kursteilnehmer willigt ein, dass seine Daten (z.B. Name, Heimatadresse, Adresse in Deutschland, Staatsangehörigkeit, Geburtsdatum und -ort) von HLS Sprachschule GmbH elektronisch erfasst werden. HLS Education Center GmbH verpflichtet sich, von diesen Daten keinen vertragswidrigen Gebrauch zu machen.

11. Wiederrufsrecht

Sie können Ihre Vertragserklärung innerhalb von 14 Tagen ohne Angabe von Gründen in Textform (z.B. Brief, Fax, E-Mail) widerrufen. Die Frist beginnt nach Erhalt dieser Belehrung in Textform, jedoch nicht vor Vertragsschluss und auch nicht vor Erfüllung unserer Informationspflichten gemäß Artikel 246 § 2 in Verbindung mit § 1 Absatz 1 und 2 EGBGB sowie unserer Pflichten gemäß § 312g Absatz 1 Satz 1 BGB in Verbindung mit Artikel 246 § 3 EGBGB. Zur Wahrung der Widerrufsfrist genügt die rechtzeitige Absendung des Widerrufs.

12. Anzuwendendes Recht, Gerichtsstand

Für den Vertrag gilt deutsches Recht. Gerichtsstand ist Bochum.
